Jury deliberating verdict in Aniya Day-Garrett murder case

Aniya, 4, was allegedly killed by her mother and her boyfriend.

CLEVELAND — The case of Sierra Day and Deonte Lewis, the couple facing murder charges in the death of Day's 4-year-old daughter Aniya Day-Garrett, is now in the hands of a jury.

Day and Lewis face the maximum punishment of life in prison without parole if convicted.

Closing arguments in the case happened Wednesday.

Below, you will find highlights from the trial, which lasted a total of five days.

Wednesday: Day 5

The prosecution rested its case in the morning, and following brief statements from the defense, closing arguments began around noon.

Prosecutors tried once more to paint a picture of a pattern of abuse, claiming Day and Lewis hurt Aniya on multiple occasions and refused to get her medical help after she suffered a stroke.

"[They] had every intention for Aniya to die," the prosecutor told the jury.

Although they are being tried concurrently, Day and Lewis are each being represented by different attorney's. Day's counselor admitted she should have gotten Aniya to a doctor, but denied she purposefully caused Aniya's death or wanted her to die.

Lewis' attorney, meanwhile, denied her client had anything to do with Aniya's death or abuse, saying it was the responsibility of the mother to take care of her and get her necessary medical attention.

"He did not abuse this child in any shape, form, or fashion," the attorney stated.

Closing arguments concluded around 3:25 p.m., and which time the jury began deliberating. The 12 left the courthouse Wednesday without a verdict being reached and will return Thursday.

Tuesday: Day 4

Sierra Day's siblings testified Tuesday morning.

Her sister revealed that she had suspicions that Aniya was being abused, and said she even told Aniya's father, Mickhal Garrett, she believed he should take custody of Aniya.

Sierra Day's sister said the pair had a falling out and she reached out to local family services about her suspicions, noting she noticed Aniya had a pattern of being covered in bruises. When she'd ask Sierra about the injuries, the sister said Sierra often blamed various accidents.

"I know for fact that a child doesn't hurt themselves that much," she said.

Sierra Day's twin brother testified that he hadn't noticed anything wrong with Aniya during the time he spent around her.

"Sierra always took care of her child," he said. "She was a good mother."

Officials from the Cuyahoga County Medical Examiner's Office also testified, presenting photos of Aniya's autopsy. Some jury members were brought to tears by the images.

Monday: Day 3

Mickhal Garrett, the father to Aniya Day-Garrett, testified Monday afternoon.

Garrett said he and Sierra Day met during Summer 2012. He said the two dated for about a year before Sierra gave birth to Aniya in September 2013. The two separated in November 2016.

Garrett said he once found bruises on Aniya's chest and back during a visitation, and Aniya told him her mother had pushed her on the stairs.

Garrett filed a police report and provided photos of Aniya's injuries. When he returned Aniya to her mother and confronted her, Sierra Day allegedly ignored him, he said. 

Garrett fought for custody of Aniya but was eventually served with a restraining order from Sierra Day, alleging that Garrett was harassing and stalking her.

When he learned of Aniya's death, Garrett said he went to Euclid police.

"I lost it. I just could not bear to think something like that. Not in a billion years," he said.

Monday's testimonies also included employees from Aniya's daycare. One said that Sierra Day was questioned about injuries Aniya had suffered, claiming that Aniya fell at the park.

One of Aniya's teachers testified that Aniya confided in her that her mother had hit her. 

The teacher discovered blood blisters on Aniya's scalp after she complained of a headache. She also had dried blood inside her ear.

"She said, 'Mommy hit me, Mommy hurt me,'" the witness said.

The teacher recalled a day Aniya was taken to a hospital after she showed up to school with scratches to the face in May 2017. Sierra Day arrived to the hospital and the teacher testified that the mother and daughter had little interaction. Police were also called and Sierra Day told them Aniya had been injured in the classroom. 

The teacher testified that Aniya only returned to the daycare once more following that incident. After that, she said she never saw Aniya again.

Friday: Day 2

A Euclid police officer who responded to Sierra Day's Lakeshore Boulevard apartment the day Aniya died testified Friday, stating that Sierra Day told him Aniya fell ill after eating at Red Lobster a few days prior. Sierra Day told the officer Aniya had been acting strange and had not been feeling well. She said Aniya fell twice in the bathroom, causing her to lose consciousness before police and an ambulance were called. 

An ER nurse who was working the day Aniya was hospitalized testified that Aniya showed signs of abuse when she arrived. The nurse said Aniya was emaciated, had bruises and scratches on her face, abrasions around her ankles, scabs on her back and was missing a tooth.

Day and Lewis are being tried together, but the attorney for Lewis argues he was not consistently in the apartment in the days leading up to Aniya's death. Meanwhile, Day's attorney claimed her client could not have killed Aniya because she wasn't in the apartment when the injuries took place.

Aniya died last March after she suffered a stroke as a result of multiple blows to the head. WKYC's investigative team found that Aniya was abused as far back as 2015 in the custody of her mother and her boyfriend. Meanwhile, Aniya's father, Mickhal Garrett, says he fought for custody of her prior to her death.

Thursday: Day 1

Prosecutors on Thursday alleged the evidence pointed to Day and Lewis becoming so into each other that Aniya had become withdrawn and seen by almost no one. She also apparently weighed less than 30 pounds and had various injuries on her body.

Aniya's death sparked local outrage after it was learned that her daycares failed to report signs of abuse. As a result, Get Ready Set Grow in Euclid will shut its doors March 31 after reaching a settlement with the state, which revoked its child care license. The day care's owners cannot apply for a new license for four years.  

A May 2017 Euclid police report showed 14 instances of abuse against Aniya dating back to 2015. The cases detail a variety of injuries including bruises, bumps and black eyes. But daycare staff at Harbor Crest failed to contact county children services about the abuse, as required.

A letter sent to Harbor Crest's owners listed 11 violations, including failure to report suspicions of abuse, staff leaving children unsupervised and providing false information when staff presented inaccurate employee records.

Harbor Crest disputed the findings but agreed to retrain its workers.
