Judge dismisses Beachwood school district's lawsuit against Warrensville Heights schools

The lawsuit claimed Warrensville Heights owed Beachwood $5 million in property tax payments following an apparent deal made back in 1997.

A Cuyahoga County judge on Wednesday dismissed a lawsuit filed by Beachwood City Schools against the Warrensville Heights City School District.

The lawsuit claimed Warrensville Heights owed Beachwood $5 million in property tax payments following an apparent deal made back in 1997. The deal, which Warrensville Heights says is invalid since it was never approved by the Ohio Board of Education, came about following the annexation of the Chagrin Highlands development.

Property taxes from the land that encompasses Chagrin Highlands was already setup to go to Warrensville Heights City Schools prior to the new city limits. Despite the city of Beachwood annexing 405 acres of the land, property taxes still belonged to Warrensville Schools.

Judge Nancy Russo granted Warrensville Heights' motion for summary judgement, which the district claims effectively throws the entire lawsuit out.

"We believe this decision will empower us to continue our progress," Warrensville Heights Superintendent Donald Jolly II said in a statement. "We are dedicated and focused on our pursuit of becoming one of the best school districts in the state of Ohio."
