CLEVELAND -- An Ohio appeals court has upheld a judge's ruling that says parts of a psychiatrist's evaluation can be used during the sentencing phase of a trial for a man charged with killing three women.
The 8th District Court of Appeals in Cleveland issued its decision Thursday in the aggravated murder case of 38-year-old Michael Madison. The women's bodies were found in garbage bags in East Cleveland in July 2013. Madison could receive the death penalty if convicted.

Defense attorneys appealed the trial judge's decision allowing Madison to be interviewed by a psychiatrist hired by prosecutors. The judge said limited information gleaned from interviews could be used during the trial's sentencing phase but not the guilt phase.
A Madison attorney says the decision will be appealed to the Ohio Supreme Court.
