WILLOUGHBY, Ohio — The Cleveland firefighter who was arrested two weeks ago and charged with voluntary manslaughter after calling police to tell them he accidentally shot his roommate faced a judge in the case Thursday morning.
During the brief hearing in Willoughby Municipal Court, 25-year-old Kevin McCarthy waived his right to a preliminary hearing and the case was bound over to a grand jury.
His $50,000 bond was also continued. Conditions of his bond include:
- House arrest with GPS monitor
- No contact with the victim's family
- Report to probation on a weekly basis
- Engage in mental health counseling

Police say it was shortly after 10 p.m. on April 14 when Willoughby dispatch received McCarthy’s call about the shooting, which happened at the Willogrove Apartments in the 37300 block of Grove Avenue.
When authorities responded to the scene, police say McCarthy was found outside of the building and detained while additional officers responded to the apartment. That’s where police say 25-year-old Christian Kilburg was found dead from an apparent gunshot wound.
McCarthy was placed under suspension without pay after his arrest pending the outcome of the court proceedings. 3News previously reported that he was hired by the Cleveland Fire Department back in 2021.
Authorities previously asked anybody with information in the case to call the Willoughby Police Detective Bureau at 440-953-4210.
We will update this story with what happens at his court hearing.
