EAST CLEVELAND, Ohio — Editor's note: the video in the player above is from a previous story.
Amid ongoing turmoil in the department, two more East Cleveland police officers have been indicted on criminal charges and suspended without pay pending the outcome of an investigation. Meanwhile, two East Cleveland officers who were previously indicted are now facing new criminal charges.
According to a release from the Cuyahoga County Prosecutor's Office, 32-year-old Kyle Wood and 33-year-old Daniel Toomer were indicted on the following charges:

- One count of Felonious Assault
- One count of Obstructing Justice
- Two counts of Telecommunications Fraud
Daniel Toomer
- One count of Theft In Office
- One count of Tampering With Evidence
- One count of Assault
- One count of Interfering With Civil Rights
- One count of Dereliction Of Duty
- One count of Obstructing Justice
- One count of Tampering Records
- One count of Disrupting Public Service
According to the release, the charges stem from a pair of incidents, the first of which occurred on March 31, 2022, when East Cleveland police officer Tyler Mundson attempted to execute a traffic stop on a 32-year-old victim in East Cleveland. Wood, Toomer and fellow East Cleveland police officer Brian Stoll proceeded to assist Mundson in the pursuit, which ended near Galewood Avenue and Ingalton Avenue in Cleveland with the victim was arrested on scene.
During the pursuit, Wood reported that the victim hit the front of his cruiser. Body camera video from the arrest, however, revealed that the victim had both hands out the window and had parked his vehicle, complying with officers’ commands.
Wood and Stoll then forcefully removed the victim from his vehicle. Body camera video later revealed Wood ramming the rear side of the victim’s vehicle.
Wood and Stoll proceeded to physically assault the victim by punching him and kneeing the victim in his head and torso while Mundson assisted in hand-cuffing the victim. Wood then falsely issued a radio dispatch stating that the victim had hit the front of his police cruiser and had resisted arrest.
A police report written by Mundson also reflected this false narrative.
The officers could also be heard discussing their assault on the victim after placing him inside the police cruiser. In the rear parking lot of the police station, Stoll took the victim’s phone, as the victim had been attempting to record the incident. Stoll proceeded to smash the phone multiple times over an object in the police cruiser, bending the phone and cracking the screen.
The second incident occurred on April 10, 2022 when Officer Toomer attempted to execute a traffic stop on a 25-year-old victim in East Cleveland. Wood, Stoll and Mundson assisted Toomer in the pursuit, which ended near 152nd Street and Lakeshore Boulevard in Cleveland.
Initially, officers reported that the victim hit the police cruiser driven by Wood during the pursuit causing him to spin out. Body camera video, however, revealed that Wood had hit the victim’s vehicle causing the crash, with body camera video also revealing that the victim had both hands up in the air and was not resisting the officers’ verbal commands during the arrest.

Following the pursuit, Stoll forcefully removed the victim from his vehicle before physically assaulting him alongside Wood. Stoll proceeded to forcefully position the victim in the back of the police cruiser.
After telling the officers on scene that he needed medical attention, the victim used his cellphone to call 911. After Cleveland EMS arrived to the scene, the East Cleveland police officers sent EMS away, stating that no one on scene needed medical assistance.
The Cleveland Division of Police (CPD) also responded to the scene, where East Cleveland officers obstructed Cleveland Police officers’ attempts to view the victim’s injuries. Despite the East Cleveland Police officer’s refusal, CPD called EMS and the victim was transported to a nearby hospital to be treated for his injuries.
Last month, Mundson and Stoll were indicted on charges of tampering with evidence regarding the March 31 incident. On Tuesday, the Cuyahoga County Prosecutor's Office announced that Mundson and Stoll have now been indicted on the following charges:

In total, nine East Cleveland police officers have been indicated on criminal charges since late-August.
