Cuyahoga County grand jury indicts 3 in connection with shootout with Cleveland officers in Brooklyn Centre

The trio are accused of attempted murder as well as a number of other crimes. One suspect was hurt after being shot by officers, none of whom were injured.

CLEVELAND — A Cuyahoga County grand jury has indicted three men in connection with a shootout with Cleveland police that resulted in one suspect being wounded by an officer last week in the Brooklyn Centre neighborhood.

Thirty-nine-year-old Ray Agosto, 32-year-old Wayne Agosto, and 25-year-old Dakota Greene have all been charged with attempted murder as well as a slew of other alleged offenses. Jurors also charged the trio for a number of other crimes prosecutors believe they committed throughout late September into October.

A fourth man who was said to be with the three suspects at the time of the shootout, 31-year-old Dylan Mitchell, was also indicted on unrelated weapons and evidence charges. Additionally, 34-year-old Jordan Stacer was charged in connection with some of the earlier incidents, though he was not with the other four during the Brooklyn Centre confrontation.

According to the Cuyahoga County Prosecutor's Office, the final encounter with Cleveland police began on Oct. 28, when Ray Agosto tried to punch his 56-year-old female neighbor at a residence near Munn Road and West 159th Street. After the victim's husband called police, officers tracked Ray Agosto to the area around West 31st Street and Denison Avenue that evening, where authorities say he was located along with Wayne Agosto, Greene, and Mitchell.

Officials claim Wayne Agosto fired his gun multiple times at the officers, who then returned fire and struck him with a bullet. He was treated at MetroHealth Medical Center for his injuries, while Mitchell was arrested at the scene.

Ray Agosto and Greene fled the area, with Greene eventually being captured at an area apartment complex. The next day, Ray Agosto was taken into custody following a two-hour standoff on West 131st that involved SWAT officers and U.S. Marshals.

Cleveland Police Chief Annie Todd said three officers were involved in the shootout, two who are employed by the city's police department and another who is a member of Northeast Ohio's Crime Gun Intelligence Center task force. None were injured in the incident.

Todd admitted at the time that the officers had been "looking for suspects involved in several violent crimes throughout the city." On Wednesday, prosecutors detailed what those alleged crimes were:

  • Sept. 30: Greene is accused of shooting at four men in a parking lot near Pearl Road and Denison.
  • Oct. 22-25: Ray Agosto allegedly forced himself into his downstairs neighbors' home and threatened to assault them. The couple later reported finding shell casings underneath their car hood.
  • Oct. 23: Amid a dispute over a vehicle with a 35-year-old man and 28-year-old woman, Ray Agosto is claimed to have driven to their home on Ferman Avenue and South Hills Drive and shot at the residence before speeding away. The male victim also told police Agosto sent him threatening text messages.
  • Oct. 27: Ray Agosto, Greene, and Stacer are alleged to have gone to the same house from the Oct. 27 incident and shot at a vehicle parked in the driveway.

"I am thankful the Cleveland officers were not injured while trying to apprehend Ray Agosto," Cuyahoga County Prosecutor Michael O'Malley said in a statement. "These violent gun-toting predators have no care in the world for our community and I am glad they are off our streets."

Officials say Cleveland police's investigation into the incidents remains ongoing.
